Dear Rosa:
The decision to excommunicate or to otherwise bar someone from the Sacraments is a power and a prerogative of ecclesiastical authorities. We can lobby a Bishop to act upon a situation, but I fail to see how we can "sue" in Church courts over this sort of issue, but then I am not a Canon Lawyer.
I guess we will see what happens.

A man is standing in line at the Pearlie Gates of Heaven waiting his turn to be assigned a room by St. Peter. Ahead of this man is a Pope and a lawyer.
The lawyer's turn comes first. St. Peter sees the lawyer and assigns him a room that is like a Penthouse Suite.
Next comes the Pope. St. Peter assigns the Pope a room that is like a Motel 6 on the Interstate.
When the man's turn comes, he cannot resist but to ask why St. Peter assign the Lawyer a Penthouse Suite and the Pope a room like Motel 6?
St. Peter replied, "well we have over 250 Popes, but this is our very first lawyer!"
